I emphasized SUBJECT TO COUNTY APPROVAL. It seems as if our local Mr. Stone and his media empire is fine with the probate judge expanding government. I would cite the article but after one of the papers in May just so happened not be able to be there what is the point. The article said the law was just changed. So I ask what law? If I look at House Bill 495 it says
Quote:
(1) The judge of the probate court may appoint one or more persons to serve as associate judges of the probate court in probate matters on a full-time or part-time basis subject to the approval of the governing authority of the county. Such associate judges of the probate court shall serve at the pleasure of the judge of the probate court.
Now I say subject to. I must first say i have the upmost respect for Kerri and Jan but this is the worst time we need to be expanding government. If we dig a little deeper we may see the law says
Quote:
(4) Compensation of the associate judges of the probate court shall be fixed by the judge of the probate court subject to the approval of the governing authority or governing authorities of the county or counties for which the associate judge of the probate court is appointed. The salary and any employment benefits of each associate judge of the probate court shall be paid from county funds. No associate judge of the probate court shall be eligible to participate in the Judges of the Probate Courts Retirement Fund of Georgia.
I can say the argument will be made it will not cost the county a dime more. I will say what was said about the election board? I think the probate office operates in an efficient manner and no changes are needed right now. I hope our elected officials are not drinking that changed law kool-aid but after this years traffic study who knows. http://www.legis.ga.gov/legis/2009_10/f ... /hb495.htm

I about flipped out last night while reading the article from the fluffer. I am amazed at the fact of Growing the Goverment is another Historical Event. He needs to get the "Historical Events" off his mind. This is just another Good Ole Boys using the taxpayers to grow goverment. I remember that this same person when she promoted the "Election Board" wouldn't cost the county any more money... Say WHAT?? Have you seen the election board's budget??????? The commissioners fell for that one just as they will this one, even if it has to be voted on. Oh and by the way there is no way in Heck that it won't cost us any more money. Growing Goverment Always COST!

This is just another "Back Room" deal cut without the taxpayers knowledge. We have been told all along that there was a hiring freeze and an employee count made ever month. But yet History was made when The Judge appointed us a New Judge!
Now here is the problem with our so called local media. Did they even know till now? If so why not asked the "Tough Questions" that would have held this Judge to some for of accountability. Where are her numbers to back up the fact that we need two probate judges in the first place. Has our crime risen that MUCH? How much will the actual training cost the taxpayers? Does this not give the appointed Judge a step up when the election time comes? Did the local Commissioners even know? These questions along with a few others (If I had time to think about it) should be asked. Will they? Heck NO... Mr. Stone wants to call it a Historical Event.
Keep in Mind that these people are YOUR EMPLOYEES and accountability is a GOOD THING!!!!!!!!!!!!!!!!!!!!!!!!!!

I heard it this morning. The assistant will have to go through the same training. That sounds like costing us money. Then they will need higher pay to equal salaries of other assistant probate judge. Then a resignation will come in with one year left so the assistant can become the Current Probate and get that (I) after the name. This law went into effect last year why did the judge do it now? Or is this a set up so if Lowery votes for it his opponent can say he expanded government.

I am amazed (not suprised) that the commission had no clue of this.
to serve as associate judges of the probate court in probate matters on a full-time or part-time basis subject to the approval of the governing authority
I seen the picture in the Sentinel and seen the "Historical Event" in the Independant...... But no where did I see where any accountability was held to this office by the Commission or the Media. I still will never understand our local media and the adgenda's they promote. Two front page articles on Mr. Johnson's Death and all the info of his past life. The other wanted to make this new expense an "Historical Event" without even doing and checking or question asking of WHY does Dade County need two Judges? Can we afford two Judges? Simple little questions that will never be answered by anyone because of the Good Ole Boys and their politics. If it had been Mr. Brandon that had approved this appointment, one news outlet would have been spinning their wheels asking questions. Ain't that right Ben? But since it part of their system, nothing will be asked. Such a shame.... Maybe "The Fluffer" can give away some more "FREE TICKETS" to this "Historical Event"...lol...lol...lol..

Maybe we need to change the headline to Commision doesn't have the guts to turn down the Judge. We will have to wait and see. First the Judge requested $3000.00 to pay for the needed training for this position. Now we have back peddled and tried to say this was a part time appointment. So does that full time employee spends 8 hours judging we will get a reduction? No we will next claim we need another part time person.
But it doesn't matter once the appointment is allowed you see that employees salary is already paid for so the commision will not be able to mess with that. Then the Judge has the Law on her side.
Quote:
(2) All full-time associate judges of the probate court shall complete the training requirements set forth for judges of the probate court in Code Section 15-9-1.1. All part-time associate judges of the probate court shall be required to attend a minimum of nine hours in an area related to probate court, mental health, or traffic matters as determined by the elected judge of the probate court. All probate required training shall be paid for by the governing authority or governing authorities of the county or counties for which the associate judge of the probate court is appointed.
should I say that agian. I didn't read that the training is subject to the approval of the governing authority. NO it says:
Quote:
All probate required training shall be paid for by the governing authority or governing authorities of the county or counties for which the associate judge of the probate court is appointed.

I just about laughed myself out of the chair watching the re-play of the meeting. As I watched "HISTORY" and a "Sermon" in the same meeting. Well at least Two Sermons. It was so funny to see the Judge admit getting the Cart before the Horse.. or as we all know what I call it... Ready, Fire, Aim, about the un-approved appointment and swearing in of another Judge. And the the Sheriff got up on the soap box, yea I said the Sheriff about the State Goverment costing counties money's. The funnisest part of the Whole Thing was to hear these elected officials talk about State money like it's not taxpayer money. It is Not the State or the County's money... It's the taxpayers money dummies......

To be FAIR on the appointment and swearing in of an associate Judge, as I heard tonite, that it had to do with the fact of "If" the Probate Judge dies while in office it will leave someone there to take over so we don't have a special election to elect a new one. Sounds pretty good with a paper and a bow but the fact remains why not do it with all the elected officials? Get all the training for ever elected officer and have them ready to "take the wheel"! I don't care how you wrap it up folks... It's still growing goverment and I'm "agin" it......

Probate Judge Jan Ellison made history Tuesday by swearing in Kerri Carter as Dade County’s new Associate Judge for the Probate Court. Georgia Law was changed last year, for the first time, to allow Judge Ellison to appoint an Associate to carry out the same duties, as prescribed by law, that apply to a Probate Judge.
And you know I gotta ask this important question. After tonite does this mean the History has been Re-Made? Can't wait to the Fluffer's report on the Station with the Information!!!!!!!!!
I kinda like the idea of UN-Swearing! Wished I could do more of that myself. This goverment has me swearing alot...lol..lol...
