After hearing numerous near misses on the worlds longest yardsale and I am sure the cost of our deputies having to concentrate on HWY 11, I would make sure you have your permit is you are having one on highway 11. It is the duty of the county to enforce the ordinace the passed. They shouldn't pass laws they don't intend to enforce equally or when they try to enforce this ordinace an entity would have cause to beat them in court. According to Ordinance 11-05-09
Quote:
Parade or special event: Any organized for-profit or nonprofit activity having as its purpose entertainment, recreation, fund raising, and/or education which takes place on state or county roads or rights of way in the unincorporated areas of Dade County, Georgia, and which requires or requests the temporary closing of state or county roads or rights of way. By way of example, special events include, but are not limited to, walks, races, parades, marches, processions, rallies, assemblies, festivals, concerts, holiday celebrations, bicycle runs, and block parties.
Producer. Any person, group of persons, organization, association, club, or other entity responsible for planning, producing and conducting an event.
It is quite clear that this is an organized event. Here is an link to prove it
http://www.us11antiquealley.com/ You can even click on the link to see specifics on Dade County there. It would not be right for the county to enforce bicycles but not this event.
Quote:
Sec. 35-2. Permits required. It shall be unlawful for any person, group, organization, association, club or other entity to conduct or cause to be conducted any parade or special event in unincorporated Dade County without having obtained a valid permit for such event.
(Ord. No. 11-05-09, § 2, 11-5-2009)
Being that this is unique reading this ordinance looks to me that beside the association requireing a permit each spot should submit $50.
Quote:
Sec. 35-3. Application; fee. (a) A producer of a special event shall make application of a permit for such event at the office of the county executive on a form prescribed by the county executive. Application forms may be obtained from the office of the county executive.
(b) An application for a special event shall be filed with the county executive at least 60 days prior to the date that event is scheduled to occur. However, no application shall be accepted earlier than one year prior to the date of the event.
(c) A nonrefundable application fee of $50.00 shall be paid at the time the application for a permit is filed. Such fee shall be payable to Dade County by cash, money order, or cashier's check.
(d) Events that are to occur along a route, including but not limited to, races, walks, runs, parades, marches, or processions, shall submit a map with the application for the permit, showing the exact route of the course for the event.
(Ord. No. 11-05-09, § 3, 11-5-2009)
You can call 657-4625 to get them to enforce this.

Well if Ted ain't "fer" it they will write a letter to Bill Marshall and see if he can route the yard sale around Dade County. But I bet that momma kinda likes seeing all that neat stuff along the hi-ways... Already heard about near misses and it's already become a saftey hazard.

The sad part is there is already a Law against "parking" along side of a Georgia State Hi-way without an emergency.. I don't think that Pair of just right used underware would qualify as an emergency....lol...lol...

I bet the DUMP will be busy today with all the "Antique Alley" stuff going there instead of being put back into storage another year. All the antique drawers (the ones that are worn) will not be held to be sold next year. It's funny to see the lines blurred about this event anyway. Why not call it like it is, a yard sale that goes on for a few miles and starts up again at the next yard sale.

I agree with David that you should not pass laws you don't intend to enforce. Otherwise, doing so is just so much symbolism over substance to give the appearance that "we're getting something done." I'm told that since January 1st 2009 the commission has passed more laws/ordinances than we passed in the previous 4 years. Are we any better off? Can anyone tell the difference? What problems existed that no longer exist as a result of the new law(s)? Of course now that the CE effectively runs the commission, water authority, tax office and now the Board of Assessors, if Hazel Doyle's comment in the paper this week about checking with the CE about a dress code counts, why don't we just do away with all the other offices and let the CE be the Czar of Dade County?

if Hazel Doyle's comment in the paper this week about checking with the CE about a dress code counts,
I spoke to Mrs. Doyle about the issue of dress codes last week. Seems funny to me that an employee of the county that is overseen by the board and has had uniforms ordered and now wants to change to shorts needs to be TOLD what to wear. Common sense these days has went by the wayside. If you notice, even the commission now dresses up for the meetings. I have always laughed at the fact of one City Commissioner who looks like a return trip from the beach when he does attend meetings, and makes the position look like a JOKE.
As far as passing laws here in Dade County, it's like we pass laws against something we don't like, and I have found that we don't like more than we like...

Well I seem to remember one where one was passed on pure rumor... Nude Dancing is not allowed in Dade County now. So all you ladies be careful what you do in your own home in the Buff you might be cited for nude dancing by the Sheriff.

And a little off subject but they passed the one against the evil Clearwater Paper Company which has going to start a hammer mill. Lot's of jobs came to Dade after that one. I wonder how the owner of the building feels about that one they passed?
